A Power of Attorney for Property is also known as a Continuing Power of Attorney. A Power of Attorney is a legal document that gives someone else the power to act on your behalf with respect to any property that you own. We only prepare Power of Attorneys for Property that is here in Canada. We do not prepare Powers of Attorney to be used in any other country other than Canada.
A Power of Attorney for Personal Care can be given to someone of your choice, so that they can make decisions for your personal care and health decisions such as where you will live, what you will eat or what medical attention or care you will receive, if you become ill or get injured.
Many potential clients have been contacting our office during COVID-19 for a Last Will and Testament to be drafted. We certainly believe that it is a crucial time for every individual to have a Last Will and Testament that sets clearly how ones affairs are to be handled in the event of an emergency.
Our office is currently operating remotely but we are happy to state that we can continue to provide services related to a draft of a Will. When we prepare Wills for our clients we usually sign off with two lawyers acting as witnesses. We then provide the original of the Will to the client and we keep a copy of the fully executed/signed Will. We do not keep the original of the Will at our office or in our storage for precisely the same issues posed by COVID-19, for example, lack of future access by our law firm to the originals.
Given the originals of the Wills cannot be signed by our staff acting as witnesses at this time, we are able to draft a fully legally drafted Will for our clients, and if we cannot sign it in person, we have been sending the draft to the client and it is perfectly reasonable and legal for the client testator to sign the will in front of any 2 witnesses which are note named in any way as an executor or beneficiary of the Will.
